Terms of Service

1. Acceptance

By creating an account, redeeming a code, or using any part of ScalpView (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you don't agree, do not use the Service.

2. Who we are

ScalpView is operated by Seafra Capital ("we," "us," "our"), founded by Seamus Synnott. Contact: [email protected].

3. What ScalpView is — and isn't

ScalpView IS: an analytical software tool that aggregates publicly available market data, computes mechanical technical indicators, displays AI-generated commentary, and provides educational utilities (e.g. risk calculators, journal, killzone tracker).

ScalpView IS NOT:

• A licensed broker, dealer, or financial advisor
• A regulated financial institution
• An investment advisor under any jurisdiction's securities laws
• A custodian of funds — we never hold your money
• An auto-trading or signal-execution service — we never place trades on your behalf
• A guarantee of any trading outcome

4. Account & access

You must be at least 18 years old to create an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity under your account.

5. Free trial & promo codes

We may offer promotional codes (e.g. LAUNCH) that grant a limited-time free trial. Trial terms:

• Trial duration is set at the time of redemption (currently 30 days for LAUNCH)
• No payment method is required during the trial
• At trial expiry, access reverts to read-only / paywall mode unless you subscribe
• We may end, modify, or remove promo codes at any time

6. Subscriptions & payments

Paid plans (Pro monthly, Lifetime one-time) are processed by our payment partner Fanbasis. By subscribing you authorize Fanbasis (and us) to charge the payment method on file.

• Pro Monthly ($20/mo): recurring subscription, billed monthly until cancelled. Cancel any time via the Fanbasis customer portal — access continues until the end of the current billing period
• Lifetime ($1,000 one-time): single payment grants ongoing access to all features and future updates released by ScalpView, for as long as the Service operates

Refunds

We offer a 14-day refund window for first-time purchases on either plan, provided you have not heavily used the Service (defined as logging fewer than 20 dashboard sessions or 5 Mega Mind queries). Email [email protected] within 14 days of purchase. Refunds outside this window are at our discretion.

7. Acceptable use

You agree NOT to:

• Resell, sublicense, or commercially exploit the Service or its data feeds
• Scrape, mirror, or reverse-engineer the Service
• Share your login credentials
• Use the Service for any unlawful purpose
• Use the AI features (Mega Mind, Trade Narrator) to generate harmful, illegal, or fraudulent content
• Attempt to bypass the paywall or trial restrictions
• Use automated tools, scripts, or bots to interact with the Service beyond normal user activity

Violation may result in immediate account termination with no refund.

8. Affiliate links & third parties

ScalpView contains affiliate referral links — most notably to FundedX (a prop firm). When you sign up for a third party through one of our links, we may earn a commission. This does not affect the price you pay. We have no control over third-party services and are not responsible for their content, fees, terms, or outcomes.

9. AI-generated content

Mega Mind, the Trade Narrator, and other AI features are powered by third-party language models (currently OpenAI and Anthropic). AI output may contain inaccuracies, hallucinations, or outdated information. Do not rely on AI commentary as the sole basis for any trading decision. Always verify with your own analysis.

10. Market data

Market data is sourced from Twelve Data and TradingView. Data may be delayed, incomplete, or contain errors. We do not warrant the accuracy or timeliness of any market data. Do not rely on ScalpView prices for actual trade execution — always confirm prices with your broker.

11. Intellectual property

All ScalpView source code, design, branding, and content (excluding third-party data) is the property of Seafra Capital. You may not copy, modify, or distribute it without written permission. The "ScalpView" name and SV logo are trademarks of Seafra Capital.

12. Termination

You may delete your account at any time by emailing [email protected]. We may suspend or terminate your access if you violate these Terms or if continued provision becomes commercially or legally unviable. On termination, paid subscribers receive a pro-rata refund for unused time (Lifetime accounts excluded).

13. Limitation of liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available", without warranty of any kind
• We are not liable for any trading losses, missed profits, broker disputes, prop firm rule violations, account breaches, or consequential damages arising from your use of the Service
• Our maximum aggregate liability to you for any claim shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100

14. Indemnification

You agree to indemnify and hold harmless Seafra Capital, its founders, employees, and partners from any claim arising out of your use of the Service or breach of these Terms.

15. Governing law

These Terms are governed by the laws of Ireland, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the courts of Ireland, unless mandatory consumer protection law in your jurisdiction requires otherwise.

16. Changes to these Terms

We may update these Terms. Material changes will be announced via email or an in-app notice at least 14 days in advance. Continued use after the effective date constitutes acceptance.
